In John Lewis Partnership v Charman, the EAT allowed an unfair dismissal claim to be brought beyond the usual three month deadline. It was decided that it was just and equitable for the employee to submit a claim after the deadline because: (a) he was unaware of the deadline; and (b) he exhausted the internal grievance and appeal processes before resorting to a claim.
